The Burgos Operational Sustainment Solutions, LLC (“The BOSS”, “Company”, “we”, “us”, or “our”) provides professional training, workforce readiness, organizational development, and wellness education services. By accessing our website, booking a service, or entering into a contract with us, you agree to the following Terms, Conditions and Service Disclaimer.

1. Acceptance of Terms

By using this website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

2. Services Provided

Burgos Operational Sustainment Solutions offers workforce readiness training, emergency preparedness certification, mental health and wellness education, organizational development consulting, leadership development programs, and related professional services to corporate, government, nonprofit, faith-based, and community clients. Services may be delivered onsite, offsite, or via approved virtual platforms.

3. Payment and Billing

We accept the following forms of payment:

  • Online booking payments via credit or debit card (Visa, Mastercard, Discover)
  • Electronic invoices
  • Corporate invoicing
  • Contract billing
  • In-person payment options

Payment terms for invoiced services are NET 30 from the invoice date unless otherwise stated in a signed contract. All fees are stated in U.S. dollars. Corporate and government clients may request a formal quote or contract prior to service delivery. Late payments beyond NET 30 may be subject to a 1.5% monthly finance charge on the outstanding balance.

A non-refundable deposit of 50% of the total service fee is required to confirm any booking. No date, session, or engagement will be held without a completed deposit. Full details are provided in our Booking and Deposit Policy.

Recurring Payment Authorization: If you enroll in any recurring training subscription, membership, or installment payment plan, you expressly authorize Burgos Operational Sustainment Solutions to charge your selected payment method on the agreed recurring schedule. By checking the acknowledgment box at checkout, you confirm that you understand and agree to the recurring charge terms, including the amount, frequency, and duration of charges. You may cancel recurring charges by providing written notice per our Cancellation Policy.

4. Booking and Scheduling

Training sessions and consultations must be booked in advance and confirmed with a deposit. Burgos Operational Sustainment Solutions reserves the right to reschedule or cancel a session due to instructor unavailability, insufficient enrollment, or circumstances beyond our reasonable control. Clients will be notified promptly of any scheduling changes.

5. Contract Terms

Where a client has executed a signed contract with Burgos Operational Sustainment Solutions, the terms of that contract shall govern and supersede these general Terms and Conditions. All contractual obligations, payment schedules, deposit requirements, and deliverables agreed upon in a signed contract are non-negotiable and binding on both parties.

6. Intellectual Property

All training curricula, instructional materials, presentations, handouts, assessment tools, program frameworks, and other content developed or delivered by Burgos Operational Sustainment Solutions are and shall remain the exclusive intellectual property of Burgos Operational Sustainment Solutions, LLC. Nothing in these Terms transfers ownership of any intellectual property to the client.

The client is granted a limited, non-exclusive, non-transferable license to use delivered materials solely for internal organizational use by participants who attended the training. Materials may not be reproduced, redistributed, resold, or used to develop competing training programs without prior written authorization from Burgos Operational Sustainment Solutions.

7. Limitation of Liability

Burgos Operational Sustainment Solutions provides educational and informational training only. Our programs are not a substitute for professional medical, psychological, legal, or emergency services. We are not liable for outcomes resulting from the application or non-application of training content. Our total liability to any client shall not exceed the total amount paid by that client for the specific service in question.

To the maximum extent permitted by applicable law, Burgos Operational Sustainment Solutions shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or these Terms.

8. Third-Party Links and Content

Our website may contain links to third-party websites. We do not endorse or assume responsibility for third-party content, policies, or practices. We encourage you to review the privacy policies and terms of any third-party sites you visit.

9. Independent Contractor

Burgos Operational Sustainment Solutions is an independent contractor and not an employee, partner, joint venture partner, or agent of any client. Nothing in these Terms shall create an employment relationship between the parties. The Company retains full control over the manner and means of delivering services, subject to the agreed scope.

10. Force Majeure

Neither party shall be held in breach of any agreement for any failure or delay in performance caused by events beyond that party’s reasonable control, including but not limited to acts of God, natural disasters, pandemic or public health emergencies, governmental orders, war, terrorism, labor disputes, or utility failures. The affected party shall provide prompt written notice of the event and its expected duration. Services affected by such events shall be rescheduled at the earliest mutually available date.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Venue for any legal action shall be in the county where Burgos Operational Sustainment Solutions maintains its principal place of business.

12. Dispute Resolution

In the event of a dispute arising out of or related to these Terms or our services, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails within thirty days, the parties agree to submit the dispute to non-binding mediation before pursuing litigation. The costs of mediation shall be shared equally between the parties.

13. Modifications

We reserve the right to update these Terms and Conditions at any time. Updates will be posted to this page with a revised effective date. Continued use of our website or services after updates are posted constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.


Service Disclaimer

The training programs, certifications, and educational services offered by Burgos Operational Sustainment Solutions, LLC are designed to provide general preparedness education, skills training, and organizational development support. These programs are not a substitute for professional medical advice, mental health treatment, emergency medical services, legal counsel, or clinical care. Completion of any course or certification does not confer licensure or qualify participants to provide professional medical, psychological, or emergency services beyond the specific scope of the certification obtained.

Mental health awareness and suicide prevention programs offered by Burgos Operational Sustainment Solutions are educational in nature and do not constitute clinical therapy, counseling, or psychiatric services. Participants experiencing a mental health crisis should contact a licensed mental health professional or call 988 (Suicide and Crisis Lifeline) immediately.

CPR, AED, First Aid, and Stop the Bleed training programs are skills-based education courses. Certification does not guarantee outcomes in real emergencies. Results may vary based on individual performance, real-world conditions, and the nature of the emergency.

Workplace safety education services offered by Burgos Operational Sustainment Solutions are delivered as awareness-level education and organizational readiness consultation. They are not OSHA-authorized compliance certification courses. Instructor credentials include OSHA Certification, Lean Six Sigma Certification, and a Master of Arts in Human Resources Development.

All training content is evidence-informed and aligned with recognized standards from the American Red Cross and other credentialing organizations where applicable. Pricing for all services is listed per program and is reasonable for the professional training and certification services provided.

The Burgos Operational Sustainment Solutions does not make medical claims, drug-related claims, or claims to treat, cure, or prevent any disease, disorder, or medical condition through its programs.
